Ask women who have suffered a femur fracture after taking Merck & Company's osteoporosis drug, Fosamax, about their recuperation and you'll likely hear that it was long and painful. Ask whether they knew that Fosamax could cause their injury and you'll likely hear that they had absolutely no idea.

Merck & Company should have warned Fosamax users
Fosamax injury lawyers say that Merck & Company should have have warned Fosamax users about serious Fosamax side effects such as femur fractures, esophageal cancer, osteonecrosis of the jaw – or ONJ – and muscle (musculoskeletal) pain. However, it did not and is now subject to thousands of Fosamax lawsuits nationwide – some of which have been consolidated into an MDL.

While Fosamax femur lawsuits continue to be filed, other lawsuits alleging that Fosamax caused ONJ have been consolidated into an MDL, or multi-district litigation, which is set up to help with the efficient economic prosecution and resolution of cases instead of having thousands of different lawsuits filed nationwide.
Generally what happens is that a panel looks at the type of cases involved and determines whether it is a mass tort. If so, they will classify it as a mass tort and will consolidate all of the cases nationwide in one United States district court.
There’s an MDL pending in the United States District Court – Southern District of New York. However, that MDL relates only to osteonecrosis of the jaw. There are also state court cases consolidated in New Jersey in front of Judge Carol Higby. Those cases involve both osteonecrosis of the jaw and femur and other long bone fractures.
