Does the type and severity of a back injury affect the amount of damages recoverable in a car accident case?

Generally, yes. Every accident claim is different and must be evaluated on the basis of the specific facts of that claim. Everyone has seen million dollar jury awards in the headlines. These cases normally involve serious injuries associated with considerable pain and suffering. However, large settlements or jury awards can result from many different types of claims, depending on the full set of circumstances on an accident.

If you are injured in an automobile accident caused by someone else, you are usually entitled to recover for lost income, medical expenses and future treatment and general damages including compensation for permanent injury, pain and suffering and emotional damages. There are many variables that can make a claim worth more or less money for purposes of settlement.

While most claims settle without a lawsuit being filed, or a case going to trial, part of evaluating a claim is based on projecting what the outcome of a jury trial would be. It is best to discuss your back injury with an experienced personal injury attorney who can give you a good idea of what your claim is worth.
