You may be able to get workers compensation for toxic mold illness. The key to getting such compensation is being able to prove that the toxic mold illness happened as a direct result of your job. Since these illnesses often don't show up until months or even years after the initial exposure, this can sometimes be tricky. 

Qualifying for Workers Compensation for Toxic Mold

Most employees are protected under the workers comp system, even for toxic mold situations. States have created these rules because they believe it is sound public policy to make sure all employees are able to pay for their medical bills and support themselves after a work injury, and because they believe that employers are in the best position to purchase insurance to make sure that happens. The best evidence in such cases would be showing that others in your work environment had an abnormally high instance of developing that type of cancer or collecting any other evidence you can about the exposure and illness you have developed.
