My slip and fall injury was covered by my insurance carrier. Will my health insurance limit my compensation for a slip and fall accident?

Health insurance may have already covered the medical bills for your injuries, but that is not the total value of your case. In fact, a large medical bill showing hospitalization, special treatments or lengthy care can up the ante for settlement because it provides a basis for claiming further disruptions to your life. Your attorney may suggest you create a list of the ways in which you have had to curtail your daily activities or give up things you have loved doing, such as dancing or golf. Sometimes keeping a diary helps you remember exactly how you felt, physically, mentally and emotionally throughout your recovery.

You may also be able to claim lost wages, pain and suffering, and other damages, which are independent of what typical health insurance would cover. Your health coverage will not limit the compensation you can collect for your fall. But if there is a big settlement, sometimes the health insurer may want to be reimbursed by the homeowner policy or other carrier for the medical bills. Your attorney may be able to assist in getting a negotiated payment with the health care provider for less than the full amount, or make a case for dropping the bill.
