Reglan: Lawsuits, Litigation & Lawyers

As a result of the serious side effects that Reglan and Metoclopramide users have experienced, lawsuits against the manufacturers of Reglan and Metoclopramide are becoming increasingly common. Since the first Reglan/Metoclopramide case was filed in 1998, there have been more than 70 Reglan/Metoclopramide lawsuits filed in federal and state courts.

The addition of the FDA blackbox warning in February 2009 has also increased user awareness and led to a rise in lawsuits against manufacturers, including claims that Reglan and Metoclopramide manufacturers most likely knew that using the drug for more than 12 weeks would lead to a significantly higher risk of developing tardive dyskinesia in the patient.

In one lawsuit filed in Arkansas in June 2009, the plaintiff, who now suffers from tardive dyskinesia, was on Reglan for over a year, beginning prior to the FDA blackbox warning in February 2009. Thus, she did not have access to the warnings about tardive dyskinesia before she began using the drug. The lawsuit’s claims include failure to warn doctors and patients of the adverse side effects, failure to use due care in development, testing, and manufacturing, encouraging the long term use of the drug, misrepresenting the effectiveness of the drug, and concealing the drug’s dangerous side effects.

In June 2009, the U.S. Judicial Panel on Multidistrict Litigation rejected a request to consolidate Reglan lawsuits into one coordinated action in one court. However, this has no impact on your ability to bring an individual claim against the manufacturer of the Reglan or Metoclopramide product that caused harm to you or a loved one.
