Tamiflu Lawsuits, Litigation & Lawyers – What You Should Know
Roche Holdings’ anti-viral drug, Tamiflu, is the only drug of its kind currently approved by the Food and Drug Administration (FDA) for the treatment of influenza. It is currently prescribed about 2 million times a year in the United States, but millions of doses are being stockpiled in case of a bird-flu pandemic. The FDA has recently required an additional warning about abnormal behavior sometimes resulting in death that has happened in patients taking Tamiflu. Most of the patients affected were children.
So far most of the incidents have been reported in Japan, and only a few have occurred in the United States. Because the issue is new in the United States, no Tamiflu lawsuits have yet been filed. Some Tamiflu attorneys are monitoring the situation and reviewing the need to file both individual and class-action Tamiflu lawsuits.
Under the laws of most states, people are allowed to file lawsuits if they have been injured by prescription drugs and if they didn’t know about the risk involved before they took the drug. The question that would be raised in Tamiflu litigation is whether the drug was defective and whether the manufacturer and distributors of the drug gave accurate and honest information to oversight agencies like the FDA and to the public.
Roche Holdings, the manufacturer of Tamiflu, claims there is no evidence that Tamiflu causes any abnormal behavior. The behavior complained of may have been caused by the illness itself. Nevertheless, when the FDA was considering requiring a new warning, Roche Holdings announced that it would add the warning whether the FDA required it or not.
