Baycol, the cholesterol-reducing drug that led to more than 100 deaths, has produced a record amount of litigation. Bayer, the manufacturer of Baycol, has announced that more than 10,000 cases have been filed by Baycol attorneys for injuries caused by the drug, and by April 2005 Bayer claimed to have paid out almost $1.2 billion in settlement in Baycol litigation around the world.

The first trial of a Baycol lawsuit was held in 2003 in Nueces County Court in Corpus Christi, Texas. Bayer offered to settle for $250,000, but when the plaintiff refused the offer, Bayer tried the case and won. Bayer won a verdict in one other case as well, but in most cases Bayer has settled. The Corpus Christi case may have gotten Bayer better settlements in later cases.

Most of the Baycol lawsuits have been filed against Bayer and its Baycol distributors, and not against health care providers. The lawsuits claim that Bayer knew about the dangers of Baycol and was negligent in informing the FDA and public about them.
