Drugs for the treatment of the condition known as Attention Deficit Hyperactivity Disorder (ADHD) have been growing in popularity among physicians in recent years with sales rising to several billion dollars annually. Concerns about deadly side effects have also been growing as these drugs have been linked to sudden death, heart attacks, strokes, and liver failure, as well as a list of lesser side effects.

ADHD drug litigation over the last few decades has centered on the drug Ritalin and its manufacturer Novartis Corporations. Several ADHD drug class action lawsuits have been filed across the U.S. claiming that Novartis conspired with the American Psychiatric Association to invent and promote the diagnosis of ADHD in order to promote sales of Ritalin. The ADHD lawsuits claim that Novartis lobbied to have the invented diagnosis, ADHD, included in the Diagnostic and Statistical Manual of Mental Disorders and that Novartis released information to health care providers and the public that encouraged the over-diagnosis of this condition.

The first ADHD drug class action lawsuit was filed in federal court in Cameron County, Texas on May 1, 2000, and several similar suits have followed. A national team of Ritalin lawyers now includes several ADHD drug attorneys formerly involved in the national tobacco litigation.

With new information about the dangerous side effects of ADHD drugs becoming available, we will be likely to see an increased number of ADHD drug lawsuits filed to recover damages for dangerous side effects about which the public has not been adequately warned. The criticism of the increased rate of ADHD drug prescriptions by physicians may also give rise to medical malpractice lawsuits for misdiagnosis and prescription of unnecessary, deadly medications to children.
