UC Davis Medical Center Settles California Birth Injury Lawsuit For Record $6M

The University of California Board of Regents has approved a California birth injury settlement between the University of California Davis Medical Center and the Hoops family for a record $6 million after doctors at UC Davis negligently failed to perform a Cesarian section in time to prevent a boy from suffering permanent neurological and physical injuries.

California medical malpractice

This California medical malpractice lawsuit involves the Hoops family and their son Cannon. According to the Sacramento Bee, Dorene Hoops was admitted to the University of California Davis Medical Center in 2005 to deliver a baby. However, during the delivery, the baby's fetal monitoring strip showed that he was in severe distress. Doctors failed to appreciate that danger and delivered the child vaginally instead of performing a Cesarian (“C”) section which caused him to suffer permanent neurological and physical injuries. Cannon, now four years old, has learning disabilities and is confined to a wheelchair a great deal of the time when he is not receiving physical therapy.

The Hoops family hired a a California birth injury attorney and filed a medical malpractice lawsuit against the hospital and the doctors responsible for the delivery. The parties settled the matter for a record $6 million – the largest medical malpractice settlement the University has ever paid. Of that amount, $4 million will be placed into annuities to pay for Cannon's future medical care, $1.75 million will be paid immediately and another $250,000 will be paid to his parents to waive future a California wrongful death lawsuit in case Cannon does not survive.
